California, which has already reduced water deliveries received through the State Water Project to zero or near zero levels, has now stopped water diversions for thousands of farmers and other users in the Sacramento-San Joaquin Delta watershed.
In early August, the California State Water Resources Control Board unanimously voted 5-0 to put new limitations on 5,700 water right holders, including farmers and landowners, preventing them from diverting more than 55 gallons per day from their adjacent water sources without prior approval. These users have long term water rights based on the location of their land adjacent to these water sources. In addition, all water use has to be reported by those who have water rights in the region. Failure to comply will result in significant fines, including penalties as high as $1,000 per day, as well as up to $2,500 for each acre-foot of water diverted without expressed permission.
The new diversion ban is expected to be approved by California’s Office of Administrative Law by mid-August.
This action stems from California’s worsening drought situation as a very dry winter has been followed by high summer temperatures adding to the state’s dire situation.
While more cutbacks to farmers are not a welcome sight, representatives of agriculture and the state’s many water districts were not summarily opposed to the State Water Board’s action. Many groups weighed in on the proposed diversion ban with many of their comments concerning the length of the ban and the mechanics of it. Western Growers, which represents many growers in the state, officially commented on the regulations as a signee of a letter generated by like associations in California.
Gail Delihant, senior director of state government affairs and a water expert for the association, agreed the state is in bad shape and efforts to better manage water use are needed. In fact, she said, “Rules mandating large amounts of water to be released from reservoirs and flushed out to the ocean in prior months and years have gotten us into this current situation. The state water system was designed for dry periods like this. We are in dire straits because of implementation of environmental rules from the State Water Board and the environmental rules due to the federal and state Endangered Species Acts.”
She said the excess use of stored water for unattainable environmental goals has depleted the resources to a critically low level.
She noted this particular ban of water diversion was ordered because the state is not achieving the environmental results it expected with the amount of water it has released from the state’s Shasta and Oroville reservoirs that was pumped through the delta and out to sea to curb salt intrusion. She said the state’s water officials are theorizing that more water is being diverted from the delta by adjacent users than is being reported. Hence, the board is banning water diversions to ensure water quality standards are able to be met.
What Western Growers and other groups are lobbying for are mitigation efforts to increase storage as soon as possible once the rainy season begins, if it does.
More water restrictions in California are expected in the coming weeks as the drought intensifies.

California water regulators took unprecedented action this week, passing an emergency regulation that will bar thousands of Californians from diverting stream and river water as the drought worsens.
The State Water Resources Control Board voted unanimously Tuesday to pass the “emergency curtailment” order for the Sacramento-San Joaquin Delta watershed. The watershed encompasses a wide swath of the state, from the Oregon border in northeastern California down into the Central Valley.
The regulation — which gives the state water board the authority to issue emergency curtailments and require reporting on water use — will go into effect about two weeks from now, subject to approval by the state Office of Administrative Law, with the issuing of formal curtailment orders to follow.
California’s complex water rights system is designed to allocate water use during times of shortage, and such curtailments, although rare, are not unheard of. But the scope of Tuesday’s order — which will apply to thousands of senior water rights across a wide swath of the state — goes beyond anything seen in prior droughts.
“The fact remains that water supplies are extremely limited, and we are running out of options,” Ernest A. Conant, Bureau of Reclamation California-Great Basin regional director, said during the meeting, expressing his agency’s support for the emergency regulations.
Some farmers strongly criticized the move, but regulators said it was necessary given the conditions.
Who is affected by the decision?
About 5,700 Northern California and Central Valley water rights holders — who collectively hold about 12,500 water rights — will be subject to the forthcoming curtailments, according to Erik Ekdahl, deputy director of the state water board’s Division of Water Rights. Once the regulation is in place, further curtailments in the delta watershed may be issued as the situation progresses.
“It really depends on compliance with this order, climate hydrology, and what water supply conditions evolve,” Ekdahl said.
The order will largely affect rights holders using water for agricultural irrigation purposes, though some municipal, industrial and commercial entities also will be affected. The regulation carves out an exemption for health and human safety purposes, meaning that water for drinking, bathing and domestic purposes won’t be subject to the curtailment.
The water board previously released a draft version of the proposed order in mid-July, following a notice of water unavailability — which urges, but does not order, people to stop diverting water. That was sent to many rights holders in mid-June.
The curtailments will create hardships for many growers, particularly those without access to well water. But the burden may be lessened by the time of year. Irrigation needs vary widely from farm to farm and crop to crop. Generally speaking, however, the biggest demands for agricultural irrigation in the delta watershed tend to be in the late spring and summer, meaning the bulk of water use for the year is likely behind many growers.
“It’s coming toward the end of the season here. As everything’s dwindling in a very dry year, the curtailments may not make a huge difference for a lot of crop types,” said Chris Scheuring, senior counsel for the California Farm Bureau.
Scheuring said the real question is what happens if drought conditions persist next year.
What prompted the decision?
The bottom line is there isn’t enough water to meet competing demands. The curtailments are necessary, according to the state water board’s finding of emergency, “to avoid catastrophic impacts to reservoir storage needed for human health and safety and other purposes.” Essentially, regulators need to drastically reduce the amount of water being diverted from rivers and streams to ensure that enough water remains for essential purposes and that those who are diverting are doing so legally.
“It’s pretty important for the integrity of the system to curtail water rights when there’s not enough water,” said Jay Lund, codirector of the Center for Watershed Sciences at UC Davis. “Otherwise, it’s just whoever gets their pump in first. And that’s not really a very fair way to do things.” In times of water shortage, rights holders are curtailed in order of seniority.
Drought conditions in the state rapidly worsened this spring, when expected snowpack runoff to the watershed decreased by almost 800,000 acre-feet — an amount nearly equivalent to the capacity of Folsom Reservoir — between April and May.
Gov. Gavin Newsom declared a drought emergency in 41 of California’s 58 counties on May 10. In that same month, many farmers were warned that they would receive little or nothing from two large allocation systems, the federal Central Valley Project and the State Water Project.
What happened to the snowpack?
“The simplest terms are the snow was kind of there and then it wasn’t,” said David Rizzardo, chief of the hydrology branch at the state’s Department of Water Resources.
Rizzardo said it’s not uncommon to lose 10%-20% of the snowpack to normal hydrological processes, particularly following a dry year. But losing just under 80% — let alone in such a short period of time?
“It’s beyond unprecedented,” Rizzardo said. The hydrologic conditions witnessed this year have been forecast in climate change models, but according to Rizzardo, such scenarios weren’t expected for decades from now.
Rizzardo characterized higher temperatures, drier soils and the effect of large-scale fires in the watershed as three of the primary factors driving the loss in projected runoff. (The effect of fires is two-fold, according to Rizzardo. The loss of tree cover and brush puts more direct sun radiation on the snow, which causes it to melt faster. Sooty debris from fires also creates dark surfaces, which absorb — rather than reflect — the sun’s radiation, causing even more melting.)
The delta itself is formed by the convergence of the Sacramento and San Joaquin rivers in the western Central Valley, but the sprawling delta watershed stretches all the way from the Oregon border in the northeastern corner of the state to just north of Fresno, encompassing much of the Sierra Nevada, as well as cities like Redding, Chico, Sacramento and Stockton.
Broadly speaking, runoff from the Sierra snowpack, which feeds major Northern California reservoirs and dozens of rivers, travels through the watershed and into the delta, which then connects to the San Francisco Bay. Water from the delta contributes to the water supply for more than two-thirds of Californians and is also used to irrigate millions of acres of farmland.
What about the rest of the state?
In July, Newsom urged all Californians to voluntarily cut their water usage by 15%, but what exactly does that mean for the average California household?
The governor made the request as he extended a regional drought emergency to 50 counties, which comprise about 42% of the state’s population. For many, the talk of water reductions reminded them of the shriveled lawns, attenuated showers and water-bucket toilet flushing of the last devastating drought.
If achieved, a voluntary 15% water reduction statewide would save roughly 850,000 acre-feet of water, which is enough to supply 1.7 million households for a year, according to the governor’s office.
In April 2015, then-Gov. Jerry Brown ordered cities and towns across California to cut water use by 25%, marking the first mandatory statewide water restrictions in state history. Californians came close to meeting the goal, with residents reducing the amount of water they used by 24.5%. Now, a handful of years after the last drought, per-capita residential water use remains about 16% below 2013 levels.
Newsom’s request is intended to bring California water production roughly back to where it dropped to in 2015 and 2016, said Marielle Pinheiro, research data specialist at the State Water Resources Control Board. Pinheiro said the number seemed feasible to the board because the state had been able to maintain those levels during the last drought.
Household water usage varies dramatically across the state based on a number of factors, but speaking in the broadest terms, Pinheiro said a 15% reduction would equate to a cut of roughly 14 gallons a day per person.
Newsom’s drought emergency declaration excludes almost all of Southern California, where the drought picture is much less dire. That’s because the region is mostly supplied by big federal and state water systems, rather than local precipitation.
The Metropolitan Water District of Southern California, which imports water from the Colorado River and the north, says it has sufficient reserves in regional reservoirs and groundwater banks — enough to carry it through this year.
Los Angeles, which is partly supplied by the MWD, similarly doesn’t expect any shortages, officials have said.

Record-breaking heat that blasted the West over the weekend is also proving to be lethal to crops. Even with the heat breaking a bit on Monday, daily records were tied or broken over the weekend across California, Nevada and Arizona, with extreme heat also hitting Idaho and portions of the Pacific Northwest.
Much of the West and Southwest have been under a heat warning for more than a week, with more than 28 million Americans seeing triple-digit heat, including Arizona, Nevada, California’s Central Valley and even parts of Washington State. The relentless heat comes just more than a week after the Pacific Northwest saw a “thousand year” heat wave that killed hundreds.
The heat and extreme drought conditions are also fueling wildfires, as well as causing orchards and farm workers to change their schedules in order to beat the heat. That’s as the National Oceanic and Atmospheric Administration (NOAA) says last month was officially the hottest June on record.
Trying to Beat the Heat with Nighttime Harvest
According to Reuters, the hottest days last month forced farm laborers to start picking cherries at 1 a.m., earlier than the normal 4 a.m. start. According to Reuters, headlamps and roving spotlights were used to aid the workers in an earlier start time in order to beat the daytime heat that threatened the workers’ safety. The extreme heat also made the fruit too soft to harvest during the day.
Reuters reports Northwest Cherry Growers still expects to see an average-sized cherry harvest this year.
"We think we probably lost about 20% of the crop," B.J. Thurlby, president of the Northwest Cherry Growers, a grower-funded trade group representing top cherry producer Washington and other Western states, told Reuters.
As reported on "The Packer" earlier this month, the Northwest Cherry Growers said the heat will force some growers to abandon a portion of their crop due to the damage caused by the heat. The issue surrounds quality. The Northwest Cherry Growers says fruit exposed to such a prolonged period of intense heat wouldn’t meet the stringent standards upheld by the Northwest growers. Unfortunately, that means that a few growers lost some or all of their crop this season.
The hot weather taking a toll on the cherry crop comes as USDA's latest sweet cherry production forecast showed production higher than 2020, but down 6% from what producers saw in 2019. USDA says the later blooming varieties were well behind the rest of the crop, which is already leading to lower yields.
Shipping Concerns
Also according to "The Packer," with temperatures topping 105 degrees for several days from June 27-30 in Wenatchee, Wash., shipping was also impacted by the extreme heat. Shippers said the heat wave could reduce the crop volume some and hold back sizing temporarily but expressed confidence there will be plenty of high-quality Washington cherries for retailers to promote in July and into August. Some are even hydro cooling cherries and taking other steps to take the heat out of fruit and using advanced sorting technology to send only strong fruit to market.
Eyes on the Apple Crop
But it’s also adding uncertainty to what the Washington apple crop will produce this year. Apples are Washington’s most valuable crop, with an estimated revenue of $2 billion each year. Apple harvest is still six weeks away, but the heat has caused the apples to stop growing for now.
"We really don't know what the effects are. We just have to ride it out," Todd Fryhover, president of the Washington Apple Commission, told Reuters.
The Washington Apple Commission says growers are doing what they can to protect their fruit against sunburn. That includes using expansive nets and spraying water vapor above the trees.

Bringing into focus some of the California crop losses caused by the 2021 drought, Western Growers has released a series of videos called “No Water = No Crops.”
The videos feature three California farmers who talk about the losses they are suffering this year.
“This is one of the most difficult decisions I’ve had to make in a long time,” Joe Del Bosque of Del Bosque Farms, Firebaugh, Calif., who sacrificed his asparagus field that still had five years’ productivity left, said in one video. “Seventy people are going to lose their jobs here. Next year, there will be no harvest here. Those 70 people lose two months of work. It’s a very difficult hit for them.”
Another video features Ross Franson of Fresno, Calif.-based Woolf Farming.
“Around this time of year, we’d normally be prepping for harvest,” Franson said in the video.
The farm has started knocking down almond trees in its 400-acre orchard, he said.
“But due to the dire drought that’s going on in the state of California right now, we made the decision to pull these trees out simply because we didn’t have the water to irrigate them.”
“These trees are all dead, and they shouldn’t be,” Jared Plumlee of Booth Ranches said in one video. The company produces citrus in Orange Cove, Calif., and destroyed 70 acres of trees because of the drought.
“It’s just a shame. This block had probably 20 years of productive life, and we were forced to push it out.”
Western Growers president and CEO Dave Puglia said in a news release that the future of agriculture in California is being compromised by the regulatory uncertainty of water deliveries to farms.
“Is that really what you want? Do you want a bunch of dust blowing through the center of the state interrupted by fields of solar panels, which don’t employ many people?” Puglia said in the release.
“It is a question that needs to be posed to Californians, generally, and their political leaders. Is that what you want? Because that is the path you are on.”

The U.S. Department of Agriculture is authorizing emergency procedures to help agricultural producers impacted by extreme drought conditions.
The USDA’s Risk Management Agency is working with crop insurance companies to streamline and accelerate the adjustment of losses and issuance of indemnity payments to crop insurance policyholders in impacted areas, according to a news release.
The agency said the new crop insurance flexibilities are part of USDA’s broader response to help producers impacted by drought, in the West, Northern Great Plains, Caribbean and other areas.
“Crop insurance helps producers weather natural disasters like drought,” RMA Acting Administrator Richard Flournoy said in the release. “We recognize the distress experienced by farmers and ranchers because of drought, and these emergency procedures will authorize insurance companies to expedite the claims process, enabling them to plant a new crop or a cover crop.”
Emergency procedures allow insurance companies to accept delayed notices of loss in certain situations, streamline paperwork, and reduce the number of required representative samples when damage is consistent, according to the release.
Producers should contact their crop insurance agent as soon as they notice damage, the agency said.
The insurance company must have an opportunity to inspect the crop before the producer puts their crop acres to another use. If the company cannot make an accurate appraisal, or the producer disagrees with the appraisal at the time the acreage is to be destroyed or no longer cared for, the insurance company and producer can determine representative sample areas to be left intact and maintained for future appraisal purposes, according to the release. Once an insured crop has been appraised and released, or representative strips have been authorized for later appraisal, the producer may cut the crop for silage, destroy it or take any other action on the land including planting a cover crop, the release said.

The past 10 to 20 years have been some of the driest on record, especially for the west coast of the United States. 70% of the land in the West is already in severe drought, and the National Weather Service estimates that the area is closer to 90%. Water demand is expected to rise by 55% by 2050, so planning how to provide more water with a diminishing supply is not a matter of whether one believes in climate change, it’s a crisis.
These climate events in the west have economic impacts worth noting water shortages during the 2015 droughts in California resulted in almost $2 billion in direct costs. On average, one drought event causes a 0.8% decrease in agricultural GDP, let alone the cost to the population.
With California responsible for a large portion of the country’s produce and experiencing extremely dry conditions, indoor farming is the only option. CEA (controlled environment agriculture) where environmental factors are manipulated can help keep the west coast's agricultural sector intact.
Greenhouses, whether traditional or vertical uses methods such as drip irrigation that save up to 30-50% of the water it would take to conventionally grow using surface irrigation. Up to half the amount of an outdoor farm. Overall, reports indicate that greenhouses create around a 60% water savings during crop cultivation.
Droughts affect not only the direct air and soil of an open farm, but also the types of pests and pathogens living in them. When a climate drastically changes, the organisms that thrive there adapt much quicker than the plant’s ability to resist them. With the U.S. already using over one billion pounds of pesticides per year, as drier environments invite new pests and pathogens that native crops are ill-equipped to handle on their own either crops will die, or pesticide use will increase.
The agricultural economy along the West Coast and indeed across the U.S. and the world will need to adapt their growing techniques to meet the demand of a growing population and conserve water. Indoor growing saves water during growing cycles and significantly reduces crop loss, pesticide use, and GHG’s.
Droughts along the West Coast are already transforming the farming landscape as we watch farmers plow crops under knowing that there won’t be enough water to sustain them throughout the summer. Crops grown indoors can be both protected and hydrated with indoor technologies that are more secure for feeding people and sustaining the planet.

As rains drop needed moisture for areas of the country dealing with drought and in need of relief, the situation is growing more dire in the West.
The latest U.S. Drought Monitor shows improvement in the Plains, especially in the Southern Plains. Heavy rains also falling across western portions of the High Plains this week, lessening the drought conditions in the western Dakotas. Those moisture improvements also pilling over into western Nebraska and Kansas.
The drought has become a mainstay in California. The Drought Monitor released Thursday shows exceptional drought growing, including Kern County, one of the top ranked counties for ag production in the nation.

As California farmers rely on Mother Nature and ground water this year, one farmer says it won't be enough to even grow a crop, with some farmers choosing to not plant at all. Some producers are even pulling out trees.
"There are land areas out here that are going to get one acre foot of water from the ground. That's what they're allocated," says Tyler Ribeiro, a dairy farmer in Tulare, California. "Good luck growing cactus on one acre foot. You're not going to be able to feed with that you can't grow trees out there. And we align with a lot of these tree guys in a sense of we feed their byproduct, I need those all almond hulls, I need those orange peels. I need a lot of those things. That's how we stay efficient [as a day farmer]."
USDA meteorologists telling AgDay there's not much relief in sight for California and the West. Forecasters expect the drought west of the Rockies to only get worse.
California Grower Groups Respond To California’s Emergency Drought Proclamation

California grower groups applauded the state’s May 10 expansion of emergency drought measures but urged caution in their implementation.
“Governor Newsom took a measured step in the right direction, but caution is needed in implementation of this proclamation,” Dave Puglia, Western Growers President, and CEO, said in a statement.
State action
On May 10, California Governor Gavin Newsom significantly expanded his April 21 drought emergency proclamation to include Klamath River, Sacramento-San Joaquin Delta and Tulare Lake Watershed counties. In total, 41 counties are now under a drought state of emergency, representing 30% of the state’s population.
Newsom also proposed a $5.1 billion package of immediate drought response and long-term water resilience investments to address immediate, emergency needs, build regional capacity to endure drought and safeguard water supplies for communities, the economy, and the environment, according to the governor’s office.
Reaction
Puglia said the declaration provides regulatory flexibility for water transfers to mitigate water shortages, and parallel executive action allocates $200 million to repair some damaged sections of key water delivery systems.
“However, the emergency authority granted to the State Water Board to curtail water deliveries should give all water users pause,” Puglia said in the statement. “Water curtailments disproportionately impact rural and disadvantaged communities. During the last drought from 2014-2016, regulatory restrictions on water deliveries resulted in the fallowing of half a million acres of productive San Joaquin Valley farmland and cost farms nearly $4 billion in economic activity. With many South-of-Delta farmers slated to receive between zero and five percent of their water allocations, 2021 is shaping up to be another catastrophic year for rural farming communities in the Valley.”
Puglia urged state water officials to lead with voluntary transfers and curtailments, which he said would give public and private water agencies the space they need to maximize limited water supplies and achieve a balance between the environmental and economic needs of the state.
“Beyond the immediate crisis, state agencies must help mitigate the impacts of changing hydrology by removing the red tape that has long prevented meaningful investments in water storage infrastructure,” he said in the statement.
California’s agricultural and rural communities can’t continue to survive without a reliable water resource, Ian LeMay, president of the California Fresh Fruit Association, said in a statement. “While drought is not an unfamiliar foe to Californians, it should be
acknowledged that this will be the first drought in the era of the Sustainable Groundwater Management Act (SGMA), with the circumstances intensified and the solutions more complex,” LeMay said in the statement. “It is the hope of the Association that today’s announcement is a step to address California’s short and long-term water resiliency.”
The governor’s approach is a “positive step,” Federico Barajas, executive director of the San Luis & Delta-Mendota Water Authority, said in a statement.
“The historic drought conditions have negatively impacted nearly 1.2 million acres of farmland, over 2 million people, many of whom live in economically disadvantaged communities, and 200,000 acres of critical habitat and managed wetlands are reliant on the water provided by members of the San Luis & Delta-Mendota Water Authority.”
“Years like this only reinforce the need for improved water conveyance and increased water storage – so that water can be moved in the years when it’s available and stored for those years when nature fails to provide adequate water for all of California’s needs,” Barajas said in the statement.
The realities of a changing climate mean California must prepare for longer, hotter droughts that can only be effectively mitigated through collaborative approaches that “focuses equally on our state’s economic and environmental sustainability,” Tom Birmingham, Westlands Water District general manager said in a statement.
“We applaud Governor Newsom’s action to mitigate the impacts of a second year of drought in the Central Valley, which has already manifested itself in fallowed fields and lost jobs due to lack of water,” Birmingham said in the statement. “In particular, his move to streamline water transfers and provide $200 million in funding for critical water infrastructure repairs as outlined in Senator Hurtado’s Senate Bill 559 will both help local communities manage drought impacts in the short term and improve drought resiliency by maximizing the beneficial use of every drop of water in the long term. “

Growing Drought: USDA Indicates 14 States Have No Topsoil Moisture In Surplus Conditions

Drier weather helped aid major planting progress for U.S. farmers last week, but it didn’t help the topsoil moisture situation.
USDA's latest Crop Progress report indicates 55% of the U.S. topsoil is considered ‘adequate,’ which is 10 points worse than this time last year. It also indicated soil moisture deteriorated from last week, when the U.S. had 59% of the topsoil in ‘adequate’ condition.
USDA shows 14 states have no topsoil moisture considered ‘surplus,’ which includes California Iowa, North Dakota, and South Dakota.
More than half of the topsoil in California, North Dakota, and New Mexico is considered ‘very short,’ which is the driest category and echoes the latest U.S. Drought Monitor that showed dry conditions intensified in the Upper Midwest.
The Climate Prediction Center’s Monthly Drought Outlook shows expectations for drought to remain parked in the West, but it’s also expected to worsen across portions of northern Iowa and Wisconsin. While CPC expects drought relief to hit southern Michigan fields, forecasters expect drought to persist across northern Michigan.
In the latest report, CPC did show some slightly good news for drought conditions.
“Heavy precipitation during late April and into the beginning of May is likely to result in either drought removal or improvement across northeast Colorado along with central to eastern Texas,” the CPC in its monthly outlook. “Persistence is likely for western Texas and also throughout the long-term drought areas of the West. Recent dryness and elevated probabilities of below-normal precipitation and above normal temperatures during May favor a return of drought to northwest Oklahoma and parts of the Texas Panhandle. Development is also favored to occur across southern Idaho and eastern Oregon by the end of May.”
